ONLINE STORE REGULATIONS

§ 1

GENERAL PROVISIONS

1. These regulations are the regulations for the provision of electronic services, referred to in Article 8, Section 1 of the Act of July 18, 2002, on the provision of electronic services (hereinafter referred to as the Regulations).

2. The Terms and Conditions define:

a. the types and scope of services provided electronically as part of the online store operating under the domain www.mat.konin.pl, operated by

b. conditions for concluding the sales agreement;

c. conditions for terminating the sales agreement;

d. right of withdrawal from the sales agreement;

e. payment method;

f. product delivery costs, methods, and deadlines;

g. complaint and warranty procedures;

h. out-of-court complaint and claim settlement procedures.

3. The Seller, either independently or at the Customer's request, shall make the Terms and Conditions available before entering into a contract for the provision of electronic services in a form that enables the access, reproduction, and recording of these Terms and Conditions through the IT system used by the Customer.

4. These Terms and Conditions are continuously available on the website www.mat.konin.pl in a manner that enables their access, reproduction, and recording by printing or saving them to a data carrier at any time.

5. The Seller is MAT Spółka z ograniczoną odpowiedzialnością with its registered office at: Jóźwin 10, 62-530 Kazimierz Biskupi.

6. The Buyer is a natural person, a legal entity, or an organizational unit without legal personality using the service provided electronically.

§ 2

DEFINITIONS

The terms used in these Terms and Conditions have the following meanings:

1. Seller – MAT Spółka z ograniczoną odpowiedzialnością with its registered office at Jóźwin 10, 62-530 Kazimierz Biskupi

2. Buyer – a natural person with full legal capacity, a natural person conducting business activity, a legal person, or an organizational unit without legal personality, to which special provisions grant legal capacity, using the services of the online store and placing orders in the store.

3. Consumer – a customer who is a consumer within the meaning of Article 22(2) of the Civil Code.

4. Entrepreneur – a customer who is an entrepreneur within the meaning of Article 43(1) of the Civil Code.

5. Entrepreneur with Consumer Rights – a Customer who is a natural person entering into a Sales Agreement directly related to their business activity, when the content of the Sales Agreement indicates that it is not of a professional nature for this Entrepreneur, arising in particular from the subject of their business activity, provided pursuant to the provisions of the Central Registration and Information on Business.

6. Account – an electronic service with an individual login and password for the Customer enabling activities in the Online Store.

7. Terms and Conditions – this document.

8. Goods/Product – a movable item, a product offered for sale in the Online Store.

9. Sales Agreement – ​​a contract for the sale of Goods within the meaning of Article 535 of the Civil Code, concluded between the Seller and the Customer.

10. Services – services provided by the Seller electronically within the meaning of the Act of 18 July 2002 on the provision of electronic services.

11. Order – a declaration of intent by the Customer aimed at concluding a Sales Agreement, specifying the type and quantity of the Goods purchased.

§ 3

TERMS OF USE OF THE ONLINE STORE

1. The Seller provides services to the Customer within the scope and under the terms specified in these Terms and Conditions.

2. The Seller undertakes to comply with these Terms and Conditions.

3. In connection with the provision of services electronically, the Service Provider uses software and technologies that ensure the security, confidentiality, and integrity of the transmitted data/information.

4. The Customer is required to:

a. have access to the Internet;

b. have a web browser, for example, Internet Explorer version 6.0 or later or Apple Safari version 3.0 or later;

c. have access to email.

5. Customers are prohibited from providing illegal content or using it in a manner that does not cause a nuisance to other Customers and the Seller.

6. Using the Online Store means any action by the Customer that leads to their viewing the content of the Online Store.

§ 4

SERVICES

1. The Seller allows the Customer to use the services offered in the Online Store free of charge.

2. The service provided electronically by the Service Provider is the sale of clothing, footwear, and personal protective equipment.

3. Service Recipients may terminate the use of the service provided electronically at any time free of charge, and may also interrupt the contract conclusion process by finalizing the ordering process in the online store.

4. The services provided electronically by the Service Provider are free of charge.

§ 5

CONDITIONS FOR CONCLUSION AND TERMINATION OF THE SALES CONTRACT AND THE RIGHT OF WITHDRAWAL

1. The Customer may conclude the sales contract electronically by completing the form available in the Online Store as part of the electronic services provided.

2. The contract is concluded upon:

a. acceptance of the content of the Order sent to the Customer;

b. consent to its implementation;

c. acceptance of the content of these Terms and Conditions;

d. confirmation of having read the right to withdraw from the Agreement.

3. The sales agreement is concluded in Polish or English, with the content consistent with these Terms and Conditions.

4. The Buyer (Consumer or Entrepreneur with Consumer rights) has the right to withdraw from the concluded agreement in writing without providing a reason within 14 (fourteen) days from the date of conclusion of the agreement, pursuant to the Act of 30 May 2014 (Journal of Laws of 2014, item 827, as amended). In the event of a written withdrawal from the agreement, the Customer is obligated to return the goods within 14 (fourteen) days.

The right referred to above also applies to a natural person – an Entrepreneur with Consumer rights – concluding a contract directly related to their business activity, when the content of the contract indicates that it is not of a professional nature for that person, arising in particular from the subject of their business activity, disclosed pursuant to the provisions of the Central Registration and Information on Business.

5. In the event of exercising the right to 14-day withdrawal, the cost of returning the goods is borne by the buyer.

§ 6

PAYMENT METHOD

1. The prices of the Goods are specified in Polish zloty and include all components, including VAT, customs duties, and other fees.

2. Payment for the placed Order can be made by:

a. payment to the Seller's bank account: ING Bank Śląski o/ KONIN 34 1050 1735 1000 0090 3111 4946;

b. electronic payment through the external payment system imoje, operated by ING Bank Śląski S.A. with its registered office in Katowice.

c. by courier upon receipt of the Order.

§ 7

PRODUCT DELIVERY COSTS, METHODS, AND TIMES

1. Delivery of Goods is available within the Republic of Poland and throughout the European Union.

2. Delivery costs depend on the total weight of the ordered products and range from PLN 12.30 gross to PLN 25.00 gross for every 30 kg of ordered products.

3. The Seller provides the following delivery methods for Goods:

a. via courier;

b. via postal operator;

4. The Customer bears the delivery costs depending on the chosen delivery method.

5. Order processing time:

a. within the Republic of Poland: 2-5 business days from the date of placing the Order;

b. within the European Union: 5-10 business days from the date of placing the Order.

§ 8

COMPLAINTS AND WARRANTY PROCEDURE

1. Goods sold in the Store are covered by the manufacturer's warranty.

2. MAT Sp. z o.o. is liable to the Consumer and Entrepreneur as a Consumer under the terms specified in the Act of May 30, 2014, on Consumer Rights (Journal of Laws of 2022, item 2337).

4. The complaint should include a brief description of the problem that is the subject of the complaint and the date and time of its occurrence.

6. The product in question, along with the attached complaint information, should be sent to:

7. Complaints will be considered based on the order number and a copy of the purchase document. Failure to provide this information will result in the complaint being rejected.

8. Each product subject to a complaint should be reported as a separate complaint, e.g., 1 pair of shoes = 1 complaint.

9. The goods submitted for complaint should meet basic hygiene requirements adopted in trade. They should be clean to allow for inspection and, if necessary, repair.

(Legal basis: Regulation of the Council of Ministers of May 30, 1995, regarding detailed conditions for concluding contracts for the sale of movable goods involving consumers, § 17.1. The goods submitted for complaint should meet basic hygiene requirements adopted in trade.)

10. Complaints will be reviewed by the Service Provider within 14 days of their receipt, and in the case of particularly complex cases, within 30 days of receipt of the complaint.

11. The Seller will inform the Customer of the outcome of the complaint in a written letter sent to the complainant's mailing address.

12. Goods may be covered by a manufacturer's, seller's, or importer's warranty. If Goods are covered by a warranty, information regarding the existence and content of the warranty, as well as the duration of the warranty, will be included in each Good's description on the Store's website.

§ 9

OUT-OF-COURT COMPLAINT AND REdress Procedures

1. The Customer – Consumer has the option of using out-of-court complaint and redress procedures, including:

a. contacting the provincial inspector of the Trade Inspection with a request to initiate mediation proceedings to amicably resolve the dispute between the Customer and the Seller;

b. filing a complaint via the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr/;

c. obtaining free assistance in resolving the dispute between the Customer and the Seller, including from the Consumer Federation and the Association of Polish Consumers.

§ 10

PERSONAL DATA PROTECTION

The Seller collects and processes personal data provided by Customers in accordance with applicable law and the Privacy Policy, which constitutes Appendix 1 to these Terms and Conditions.

§ 11

FINAL PROVISIONS

1. These Terms and Conditions are effective from January 1, 2025.

2. The Seller may amend the provisions of these Terms and Conditions for legitimate reasons, such as changes in applicable law.

3. The text of these Terms and Conditions is available on the website www.mat.konin.pl.

4. The Terms and Conditions may be saved, downloaded, and reproduced at any time by printing or saving them on an appropriate medium.

5. In matters not regulated by these Terms and Conditions, the provisions of:

a. the Civil Code;

b. the Act on the Provision of Electronic Services;

c. the Consumer Rights Act and other relevant provisions of Polish law shall apply.

6. The court having jurisdiction to resolve any disputes between the Seller and the Customer shall be the court having jurisdiction over the Seller's registered office.
